My services consist of the advise, comment, suggestion, feedback, statement, data, information, code or content I provide.

 

I provide my services through this website, through electronic communication, in person or through a combination of these, directly or indirectly.

 

This website refers to the means I provide my services using the domain brightidiaz.com and its sub-domains. My services provided through this website means that you would have accessed, or you will have to access, them using a uniform resource locator (URL) with includes the string brightidiaz.com in it, tacitly or otherwise. A URL string may not tacitly include a string if a URL redirection or a URL alias is used, or when when the machine Internet Protocol (IP) address is used instead of a valid DNS domain name, or when similar alternatives are employed.

 

You are using my services if you access my services, if you receive my services, or if you make any action, inaction, decision or indecision based on, informed by, or in any way influenced by my services.

 

You are using my services if you share my services to anyone or to no one in particular. You are using my services if others make any action, inaction, decision or indecision based on, informed by, or in any way influenced by my services which you would have shared with them.

 

You are NOT using my services if you decide to use the services of an immigration agent, even if the immigration agent is one I have recommended. The services an immigration agent provides is distinct, separate and not part of the services I provide. It shall be subject to the terms and conditions of services of the immigration agent, and for all intents and purposes, I am a third party and a stranger to whatever arrangement or agreement you had and you may have with that immigration agent.

 

Conditions of Use

By using my services, you agree to be bound by these Terms and Conditions:  

  1. You are solely responsible for any consequence and all consequences of your use of my services. I have not given, I do not give, and I will not give any guarantee, expressed or implied, of any outcome arising from your use of my services, whether such use is in whole or in part.
  2. You hold me, my heirs and assigns free, and you will hold me, my heirs and assigns free, from any liability under the law, tort and principles of equity that may arise from your use of my services. You likewise undertake to defend me, my heirs and assigns from any third party claim resulting from your use of my services.
  3. You agree that should there be any dispute between us, you will first endeavour to resolve it with me amicably. If we cannot resolve the dispute between us by ourselves, we will submit it to voluntary arbitration in the city recorded as my place of business in the most recent and updated entry in the Australian Business Registry for my ABN as sole trader.
  4. If we cannot resolve the dispute between use even after arbitration and the dispute will have to be brought before any court of law, administrative tribunal, or any government authority for the adjudication of our rights, you agree that the relevant court, tribunal or authority in the State of New South Wales, Australia, will have jurisdiction to the exclusion of all other courts, tribunals and authorities.

Refund Policy

In general, I provide my services for free. However, in the instance(s) that you have availed of premium services where I have collected fees, you agree to the following:  

  1. Refund is available only for money paid to me for services that I provide. Money paid for the services of a third party, such as an education provider or an immigration agent shall be subject to the refund policy of the education provider or the immigration agent.
  2. The amount of refund you can get shall be capped at an amount representing the amount I have actually received in my bank account less the fees or charges I will incur for transferring the money back to you. If the money paid to me is not in Australian currency, you shall bear the loss incurred and to be incurred in currency conversion.
  3. Refund is available only by the same manner you have paid me. Thus, if you use PayPal, refund will be made through Paypal. If you made a direct deposit, refund will be made through direct deposit.
  4. Refund is available only if you have notified me of your decision to discontinue using my services. You must notify me of your decision to discontinue using my services in writing which I must receive as an email or in paper form.
  5. You will receive one hundred percent (100%) of the amount of refund you can get if you notify me of your decision to discontinue using my services before you give your confirmation to proceed with an application. You can give your confirmation to proceed with an application by any means of electronic communications.
  6. In all other circumstances, refund will not be available.
